TERMS & CONDITIONS

INK Parfum (“INK Parfum”, “we”, “us” and “our”) is an independent fragrance brand based in Singapore. We operate this website at inkparfum.com (the “Site”) and we are the seller of every product offered on it. You can reach us at contact.inkparfum@gmail.com.

These Terms govern your access to and use of the Site, and every order you place through it. They apply together with our Returns & Shipping Policy and our Privacy Policy, each of which forms part of these Terms. Where a document deals with a subject more specifically — for example what happens if a fragrance arrives damaged — that document applies to that subject.

• “Site” means this website and every page, feature and checkout flow on it.
• “Product” means any fragrance we offer for sale, including both ranges below.
• “Signature Fragrance” means a pre-composed fragrance from our ready-made range, sold in its fixed formulation.
• “Personalised Fragrance” means a fragrance composed through Create a Scent to the note selections you confirm, including any bottle name you supply.
• “Order” means a request you submit through the Site to buy a Product.
• “Working Day” means Monday to Friday, excluding Singapore public holidays. We use this definition when we describe our processing times.
• “Consumer” means an individual acting for purposes wholly or mainly outside that individual’s trade, business, craft or profession.

By browsing the Site, you accept these Terms. By placing an order, you confirm that you have read and agree to them. If you do not agree, please do not use the Site or order from it.

At checkout you are asked to confirm, by ticking a box that is not pre-selected, that you have read and agree to these Terms and the Returns & Shipping Policy, and that you acknowledge the Privacy Policy. That confirmation is mandatory: we cannot accept or take payment for an order without it.

You agree to use the Site lawfully and not to interfere with its operation, attempt to gain access to systems or data you are not authorised to access, submit false or misleading information, or use automated means to extract content or place orders. We may suspend or withdraw access to the Site, in whole or in part, where we reasonably consider this necessary to protect the Site, our customers or our business.

These Terms, and any dispute arising out of or in connection with them or the Site, are governed by the laws of Singapore. Subject to clause 10.8, the courts of Singapore have jurisdiction.

• Earlier versions are available on request by writing to contact.inkparfum@gmail.com. We keep a record of each published version and the date it took effect.
• The version of these Terms that you accepted when you placed an order is recorded with that order and applies to it. A later version will not be applied retrospectively to an earlier purchase.

Every INK Parfum fragrance is a 30 ml eau de parfum. We offer two ranges: Signature Fragrances, which are pre-composed, and Personalised Fragrances, which are composed through Create a Scent to your confirmed note selections.

Our ready-made range currently comprises three fragrances — Signature 01, Petals and Burnt Pages — each at S$39.90. Their formulations are fixed: they are not altered to individual orders.

A fragrance composed through Create a Scent is offered at S$49.90. How that process works, and what you should expect from the finished scent, is set out in sections 3 and 4.

All prices are quoted in Singapore dollars (SGD). INK Parfum is not currently registered for Goods and Services Tax (GST). We do not charge GST, no GST is added at checkout, and no GST line appears on your order summary, confirmation or receipt.

Delivery is charged separately and is shown to you, as a distinct line, before you pay. The amount you see at the point of payment is the amount we will charge you.

Our photography is editorial and intended to convey the character of each fragrance. Colour reproduction varies between screens. Bottle, label and box presentation may change between production batches without any change to the fragrance itself. A Personalised Fragrance carries the name you supplied, where you supplied one.

Perfume materials are natural or nature-derived and vary slightly between harvests and batches. Concentrated fragrances can also deepen in colour over time, particularly where they are exposed to light. Small differences in colour or in the intensity of a single note are normal characteristics of perfumery and are not, by themselves, a defect.

All Products are subject to availability. We may withdraw a fragrance, limit the quantity available to a single customer, or change a formulation in a way that is clearly notified on the Site. If we cannot fulfil an order we have accepted, we will tell you promptly and provide a full refund or, where you prefer it, an alternative resolution (see clause 7.6).

We describe each fragrance by its notes, its family and its character. We do not claim that any Product is approved, certified, licensed or notified by any regulatory authority where we do not hold that status, and we do not claim that a fragrance is suitable for every person. Care and safety information is set out in section 8.

Create a Scent begins with a short questionnaire. On the basis of your answers, the quiz recommends two notes from each fragrance layer: Top, Heart and Base. From there you are in control. You choose the notes you want, and you may select up to three notes from each layer. The quiz recommendations are a starting point only: you are not required to keep them, and you may replace or add to them within the interface.

The note selections you confirm — together with any bottle name you enter — form the specification for your order. Your selections are captured with the order and travel with it into production, so the fragrance we make is the fragrance you configured.

The final review screen shows your Top, Heart and Base selections in full before you add the bottle to your bag, and again in your bag and at checkout. Please check it carefully. Once your fragrance has been produced, we cannot change its composition (subject to section 7 and to your rights under applicable law).

Personalised Fragrances are blended in small quantities to your confirmed selections. Very small variations in colour or intensity between individual bottles can occur. These do not mean the fragrance has been made to anything other than your confirmed order.

There is no separate “optional scent” step in Create a Scent. Everything that defines your fragrance is contained in the Top, Heart and Base selections you confirm, plus any bottle name you choose to add.

A bottle name is optional and limited to 28 characters. Where you provide one, we reproduce it on your bottle. Clause 9.4 sets out what you confirm about the name you supply.

Fragrance preferences are personal and subjective. The scent of a completed personalised fragrance may differ from your initial expectations, even when it has been produced in accordance with the notes you selected. Individual scent perception, skin chemistry, the way a fragrance is applied, and environmental conditions all influence how a fragrance is experienced.

Our questionnaire and our fragrance descriptions are intended to guide you in exploring scent combinations. They do not guarantee that you will enjoy the finished fragrance, or that you will experience any particular scent impression.

We encourage you to review your selected notes carefully before confirming your order. The final review screen, your bag and the checkout summary all display exactly what you have chosen.

Where a personalised fragrance has been correctly produced in accordance with your confirmed order, and is otherwise of satisfactory quality and consistent with its description, dissatisfaction based solely on personal scent preference does not automatically entitle you to a refund or exchange.

INK Parfum may, at its discretion, consider goodwill assistance on a case-by-case basis. Any such assistance is voluntary and does not establish an ongoing guarantee, policy or entitlement. The forms this assistance may take are described in our Returns & Shipping Policy.

Nothing in this section limits or excludes any remedy available to you under applicable Singapore consumer-protection law in respect of products that are defective, incorrectly supplied, not of satisfactory quality, not fit for purpose, or materially misdescribed. Those remedies are set out in the Returns & Shipping Policy and are unaffected by this section.

Signature Fragrances are composed by us in advance and sold in their fixed formulation. Their note composition cannot be changed, and it cannot be modified through Create a Scent.

A Signature Fragrance is not a Personalised Fragrance. If you would like a fragrance composed around notes you choose, Create a Scent is the appropriate route; sections 3 and 4 then apply to that order.

Because they are not made to an individual order, sealed Signature Fragrances bought directly from us may be returned within 7 calendar days of delivery under our voluntary change-of-mind procedure, provided they are unopened and unused. The full conditions are set out in the Returns & Shipping Policy. Rights you have in respect of faulty or misdescribed products are unaffected.

You must be at least 18 years old, or have the consent of a parent or guardian, and be capable of entering into a binding contract, to place an order. We currently deliver within Singapore only; an order must therefore carry a Singapore delivery address.

Please give us accurate, current information — including your full name, contact number, email address and delivery address. You are responsible for the details you provide. If you notice an error after ordering, contact us immediately; we will correct it if your order has not yet been dispatched.

Submitting an order is an offer to buy the Products in it. You will see a confirmation screen when your order has been received. We confirm and accept an order when we send you an order confirmation and begin processing it. If we cannot accept an order — for example because a Product is unavailable, a price was displayed in error, or a payment is not authorised — we will tell you and will not charge you for that order.

Order confirmation does not by itself remove any right you have to cancel under section 7, and it does not affect your statutory rights in respect of faulty or misdescribed goods.

Card payments are processed by our payment provider on its own hosted payment page. We do not receive, and do not store, your full card number. Payment must be authorised before we begin making your fragrance; an order awaiting payment will not enter production.

The amount charged is the product price shown at checkout plus any delivery charge shown to you before payment. No GST or other tax is added. Delivery is free once your item subtotal reaches S$89.

If a payment fails, no order is created and you will be returned to checkout to try again. If you believe you have been charged twice for the same order, contact us with your order number and the date of the charge. Once a duplicate authorisation or charge is verified, we will void or refund it.

We try to ensure that prices and descriptions are accurate. If a price is obviously wrong (for example a clear typographical error), we may cancel the affected order and refund you in full. We will not charge you more than the price displayed and confirmed at checkout without your agreement.

We may refuse or cancel an order, and refund any payment received, where we reasonably suspect fraud, unauthorised use of a payment instrument, or other unlawful activity. Where appropriate, we may report the matter to the relevant authorities.

Keep your order confirmation and order number. They are the reference we use for cancellations, returns, delivery enquiries and any claim about a product.

You may ask us to cancel a Personalised Fragrance order at any time before production begins. Production begins when we start order-specific preparation of your fragrance — that is, when we begin blending, filling or labelling a batch for your order. It does not begin when payment is received.

Write to contact.inkparfum@gmail.com with your order number as soon as you decide. We will confirm in writing whether we have been able to stop the order, and we will refund any amount paid for it where the cancellation is accepted.

If we cannot establish whether production had already begun when your request arrived, we will not refuse the cancellation on that basis alone. We will review the order with you and resolve the position fairly.

A Signature Fragrance order may be cancelled before it is dispatched. Once dispatched, the voluntary return procedure in the Returns & Shipping Policy applies instead.

Once production of a Personalised Fragrance has begun, changes to its composition and change-of-mind cancellations may generally be declined, because the fragrance cannot be resold. We may still agree to a change or cancellation at our discretion, and this clause does not affect any right you have under applicable law.

If we cannot fulfil an order we have accepted — for example because a fragrance is unavailable, a batch has failed quality checks, or we cannot deliver to your address — we will tell you promptly and provide a full refund of the amount paid, or another resolution you agree to. Refunds are made to the original payment method where feasible.

Where a cancellation or refund is approved, we will confirm the expected timeframe to you in writing at the time of approval. Refunds are subject to the processing time of your bank or card issuer once we have released them.

Our fragrances are cosmetic products for external use only. They are not intended for ingestion and must not be applied to mucous membranes.

Avoid contact with the eyes. If a fragrance gets into your eyes, rinse thoroughly with clean water and seek medical advice if irritation persists.

Do not apply a fragrance to broken, irritated, sunburnt or otherwise compromised skin.

Fragrances contain alcohol and are flammable. Keep them away from flames, heat and ignition sources, do not spray near a naked flame or a lit cigarette, and store them away from direct sunlight and heat.

Store your fragrance upright with the cap closed, in a cool, dark place. Follow any storage instructions supplied with the product.

Keep fragrances out of the reach of children and away from pets. Glass bottles should be handled carefully.

Stop using the fragrance if you notice irritation, redness or any other reaction, and seek medical advice where appropriate. Take the product or its note list with you if you do.

Fragrance compositions contain many individual materials, and we cannot represent that any fragrance is free from every substance to which a person may be sensitive. If you have a known sensitivity or allergy, tell us before you order and we will share the relevant ingredient information so that you can decide.

Nothing in this section transfers responsibility for the safety and quality of our products to you. We remain responsible for the product safety, labelling and quality obligations that apply to us by law.

The Site and everything on it — text, photography, film, illustrations, fragrance names, descriptive copy, layout, design and brand marks — is owned by INK Parfum or used under licence, and is protected by copyright, trade mark and other laws.

You may view, download and print pages of the Site for your own personal, non-commercial use, and share links to our pages. You may not copy, republish, sell, license, modify or distribute our content, use it in advertising, or present it as your own, without our written permission.

Payment brand names and logos shown at checkout belong to their respective owners and are used to indicate the payment methods we accept.

Where you supply a name for a Personalised Fragrance, you confirm that you have the right to use it and that it does not infringe the rights of any other person or contain unlawful, threatening, defamatory or otherwise objectionable material. We may decline or ask you to change a name for that reason. You keep ownership of your name; you give us a limited licence to reproduce it on your bottle, its label and your order records, for the purpose of fulfilling and supporting that order.

If you submit a review, you keep ownership of what you write and grant us permission to display it on the Site alongside the display name you provide. You confirm that the review reflects your genuine experience of the product.

If you believe content on the Site infringes your rights, write to contact.inkparfum@gmail.com with enough detail for us to identify the material and assess the claim.

Nothing in these Terms excludes or limits our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, for breach of any obligation that cannot lawfully be limited, or for any right you have as a consumer that cannot lawfully be excluded or restricted.

If something is wrong with your order, write to contact.inkparfum@gmail.com with your order number and a description of the issue. Photographs are helpful and we may ask for them, but they are not a precondition to a claim. We will investigate, keep you informed, and respond to you in writing.

If we supply the wrong product, make a personalised order that does not match your confirmed selections, or supply a product that is damaged, faulty or materially misdescribed, we will put it right. Depending on the circumstances this may mean a replacement, a repair, a refund or another resolution, as set out in the Returns & Shipping Policy.

The Site is provided on an “as available” basis. We do not guarantee that it will be uninterrupted, error-free or available at every moment, and we may suspend it for maintenance or to correct a fault. Where we become aware of an error in pricing or product information, we will correct it as soon as reasonably practicable.

We are not liable for a failure or delay caused by something outside our reasonable control, such as courier disruption, severe weather, a public holiday surge, an interruption in supply, or a public health measure. Where this happens, we will tell you promptly and work with you on a fair resolution.

Subject to clause 10.1, and to the extent permitted by law: we are not liable for indirect, incidental or consequential loss, or for loss of profit, business or goodwill; and our total liability arising out of or in connection with a Product is limited to the amount you paid for that Product (or, where a replacement is provided, the cost of that replacement).

Nothing in these Terms affects your rights under Singapore consumer-protection law, including the Consumer Protection (Fair Trading) Act and the Sale of Goods Act, in respect of goods that are not of satisfactory quality, not fit for purpose or not as described.

We would like the chance to resolve any concern directly first. Please raise it with us in writing and allow us a reasonable opportunity to respond. If a dispute cannot be resolved between us, we are willing to consider mediation before either of us starts court proceedings.

These Terms are governed by the laws of Singapore, and the courts of Singapore have jurisdiction over any dispute arising out of or in connection with them.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down to the minimum extent necessary, or removed, and the remaining provisions will continue in full force.

We may update these Terms from time to time — for example to reflect a change in our processes or in the law. The current version and its effective date are shown at the top of this page. A change applies from its effective date and does not alter the terms that applied to an order you had already placed, which are recorded with that order.
